User understands, absolutely agrees without any qualification whatsoever that the right granted herein is only to view or witness the event or material as streamed by the Publisher in consideration of the streaming fees. As such, no copyright ownership or any rights of similar import is conveyed to the User; Stratuscast, hereinafter referred to as Publisher retains absolute and exclusive control on the access rights to the streaming of the material or event to be viewed. User is any person or entity who views or witnesses any streamed material or event by the Publisher;
Publisher owns the website or page facilitated by the streaming as a portal. By using Publisher’s site, data feeds, software and services provided, user signifies agreement to the terms and conditions herein defined. Publisher in its sole discretion, may modify or revise these Terms of Service and policies at any time, and User agrees to be bound by such modifications or revisions;
User agrees not to access the data or content to be streamed or provided by Publisher through the use of any other technology other than the video playback package or facility provided for by the Publisher; User agrees not to use or launch any automated system, including without limitation, "robots," "spiders," or "offline readers," that accesses the facility, server or service of Publisher in a manner that sends more request messages in a given period of time than a human can reasonably produce in the same period by using a conventional on-line web browser;
User may only be solely liable for the unauthorized use of Publisher’s account, However, Publisher will not be liable in any way for such un authorized or unwarranted use;
In addition of Publisher’s right to discontinue any aspect of its services to Users at any time, Publisher reserves the right to withhold streaming if, based on sufficient or on its well founded belief, User commits any of the following;
Fails or refuses to pay the necessary service and streaming fees to the Publisher;
Reproduces, downloads, distributes or saves the material, footage or streamed event without any authority from Publisher;
Violates any other conditions of this Publisher-User Terms and Conditions of Use;
In addition to the rights herein established, Publisher may prosecute or file claims against User for violating Publishers intellectual property rights including the procurement of streaming
The contents, material or events streamed or any of those appearing on the functionality on the site or portal utilized by the Publisher are owned by or licensed to the Publisher subject to applicable copyright and intellectual property laws. The contents, materials or events streamed are provided to the User on “As Is “ basis. The Publisher and/or its licensor reserves all the rights on the content not stated herein.
User agrees not to collect or harvest any personally identifiable information, including account names, from the Publisher through its service or functionality, nor to use the communication systems provided by the Publisher (e.g., comments, email) for any commercial solicitation purposes. User agrees that the use of the services shall be at at his risk. To the fullest extent permitted by law, publisher , its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the services and your use thereof;
User may be exposed to content that is inaccurate, offensive, indecent, or objectionable, and you agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against Publisher with respect thereto, and, to the extent permitted by applicable law, agree to indemnify and hold harmless Publisher, its owners, operators, affiliates, licensors, and licensees to the fullest extent allowed by law regarding all matters related on the use of the facility;

The exclusive right to view the streamed material or content granted to the User may not be assigned. Publisher may however assign the provision of the service to any other entity without notice or consent of the User.
The website or portal using the services provided by Publisher shall be deemed a passive website or portal that does not give rise to personal jurisdiction over the Publisher. If any provision herein is demmed invalid, the remaining provisions maintain force and effect. No waiver of any term of this these provisions shall be deemed a further or continuing waiver of such term or any other term, and Publisher's failure to assert any right or provision under these agreement shall not constitute a waiver of such right or provision. It is hereby agreed that any claims or cause of action that User may have against Publisher not commenced within one (1) year from the accrual of such right shall be deemed waived.
